MOSAIC CD-ROM & MULTIMEDIA
For the purposes of this document, will be referred to as ‘Mosaic’.
Before proceeding with any project, Mosaic asks that Clients read the following terms and conditions, and sign the agreement that Mosaic presents to confirm they have done so and that they understand and agree to these terms.
TERMS & CONDITIONS OF SERVICE:
WEB DESIGN SERVICES:
Every project must be discussed fully in order to establish the Client’s exact requirements - before a quotation can be provided. That consultation is free.
A quotation will be provided in writing, and if agreed by the Client, an estimated start date for the project will be confirmed by Mosaic.
Upon receipt of all files / elements (logo, literature, documents, photos etc.) a prototype design/layout will be presented to the Client.
Upon agreement to proceed, a ‘Sign Off’ date for the project will be presented to the Client for approval. This ‘sign off’ date is the date by which Mosaic estimates the web site will be finished, not necessarily the date by which the site goes ‘live’ to the public (the ‘live’ date can vary slightly, this is usually when third party services are involved, services which connect into The Client’s website – such as payment processing companies for an e-commerce website).
The Client will receive a final invoice at this point.
Mosaic agrees to utilise all standard procedures which ensure the Client’s website is available to the internet search engines, i.e. input Meta Tags appropriately and give advice on registration to the most popular search engines.
Please Note: Mosaic is NOT responsible for securing high search engine ratings for the Client’s website. We can, however give advice to the Client of ways in which to market their website and gain higher ratings with the search engines.
Mosaic observe current accessibility requirements and endeavour to make a Client’s website readable by all web browsers, on Mac and PC - and with aids such as ‘Screen readers’ which are used by those with visibility problems.
PLEASE NOTE: A deposit will be required in advance (usually equal to 30% of the total price of the full web / design project development costs quoted) - for larger commissions such as E-Commerce and Database Driven Website projects – this is to cover software purchase costs (where applicable), all research on our client’s behalf, and installation of software prior to testing.
*Where a domain name and Web Hosting package is ordered, this will be invoiced and paid separately in advance of any design work.
DOMAIN REGISTRATION:
Mosaic acts as Agent to our Clients when registering a Domain Name – the contract for the registration is between the Client and the appropriate Naming Authority, therefore the Client is bound by the terms and conditions of the Naming authority.
It is the Client’s responsibility to pay for all domain names / renewals in advance.
Mosaic will notify Clients when a domain name we have registered on their behalf is due for renewal.
Mosaic CANNOT be held responsible for any domain name lost due to non-payment in advance.
Please note the results of your domain registration may not always be accurate. In rare circumstances such as central registrar outage, heavy server loads, database overload, etc, the system may return a: "registration successful" when the name has actually not been registered at all.
You should confirm after 48 hours that the domain/s is/are yours at the central shared registry whois at www.internic.net or www.nic.uk for 100% accuracy.
Mosaic reserves the right to change these Policies without prior notice or warning. Non-enforcement of any part of these Policies does not constitute consent.
Violations of these Policies should be referred to info@mosaicmultimedia.co.uk
All complaints will be investigated promptly.
Mosaic gives no warranty that the Domain Name requested would not infringe the rights of any third party – Mosaic cannot be held responsible in respect of any such infringements.
WEB HOSTING & DATABASES:
Mosaic provides web hosting and database set-up to numerous clients, which means that we have a responsibility to protect each client and to provide the best services available. Part of our service is to ensure that we notify the Client of their renewal dates for server hosting and databases.
All web hosting and database set-up is payable in advance, on a per annum basis. (Databases are set up in order to run database driven websites, and software such as galleries, bulletin boards etc.)
Data stored on our servers is not backed up by guarantee. We can however recommend ways of independently backing up all data stored in your space and provide this facility for a fee.
Websites hosted on our servers may not run server processes (e.g. talkers/IRC bots). Sorry, No Chatrooms.
To protect your privacy we never distribute your name or e-mail address to any third parties.
By logging into your web hosting account, or uploading files to it, you are indicating your acceptance of these terms and conditions.
UNACCEPTABLE USES:
These include spamming (sending unsolicited advertising to those with which the customer has no existing business relationship, posting off-topic advertising in newsgroups); spoofing (using a return email address which is not the valid reply address of the sender or sending an email message which does not contain enough information to enable the recipient to identify the party who is really sending the message; passive spamming (promoting a web site hosted with us by spamming from some other source), trolling (posting controversial messages in newsgroups to generate responses), mail-bombing (inundating a user with email without any serious intent to correspond), generating a higher volume of outgoing mail than a normal user (20% or more of available system resources), and subscribing someone else to an electronic mailing list without that person's permission.
A message is considered unsolicited if it is posted in violation of a newsgroup charter or sent to a recipient who has not requested the message.
Making an email address available to the public does not constitute a request to receive messages. Distribution of mass emailing programs is also prohibited. All recipients on a mailing list must have personally subscribed.
Mailing lists may not be used to distribute unsolicited email. Any customer repeatedly "mail-bombed" or that attracts such behaviour will be asked to leave.

We also do not allow sites selling so-called "spam-ware".
Abuse of the legal rights of others:
Abuse of the legal rights of others: Examples of unacceptable activities in this regard include posting private information about a person without their consent, infringing intellectual property rights, defaming a person or business, and knowingly making available code which will have a deleterious effect on third party computers.
Mosaic supports free speech on the Internet, and will not suspend or cancel a customer’s account simply because it disagrees with the views expressed by the customer. Where there are allegations that a customer’s on-line activity has violated the legal rights of a third party, Mosaic will not substitute itself for a court of law in deciding tort claims raised by the third party.
Abuse of the law:
Mosaic’s services may be used for lawful purposes only.
Illegality includes but is not limited to: drug dealing; attempting without authorization to access a computer system; pirating (distributing copyrighted material in violation of copyright law, specifically MP3s, MPEG's, ROMs, and ROM emulators); gambling; schemes to defraud; trafficking in obscene material; sending a message or having content that is obscene, lewd, lascivious, filthy, or indecent with intent to annoy, abuse, threaten, or harass another person; threatening bodily harm or damage to individuals or groups; violating U.K. export restrictions; stalking; or violating other state or federal law such as the Electronic Communications Privacy Act, the Computer Fraud and Abuse Act, or the Economic Espionage Act.
Linking to illegal material is also prohibited. Mosaic reserves the right to check system files, email, and other data on our servers for illegal content and materials, or for any other reasons deemed necessary.
Pornography:
Pornography and sex-related merchandising, or links to such material, even if legal, is not an acceptable use of our servers.
Abuse of Mosaic Multimedia’s Hosting Resources:
Running programs in the background on our server without Mosaic’s prior written authorization, or running chat rooms, Internet Relay Chat, IRC bots, and the like are not acceptable uses of Mosaic’s servers.
Further, any usage of twenty percent (20%) or more of our system resources is an undue burden on our system and is unacceptable. If your usage ever exceeds twenty percent (20%) of system resources, you will be contacted and asked to eliminate the problem.
In addition, any domain that exceeds ten gigabytes of bandwidth traffic can be terminated without prior notice.
Hacking/Cracking:
Mosaic Multimedia reserves the right to report illegal activities to any and all regulatory, administrative, and/or governmental authorities for prosecution.
OTHER BEHAVIOR:
The following examples of unacceptable behaviour are non-exclusive, and are provided for guidance purposes. If you are unsure if your actions will be a violation of our policies please ask: info@mosaicmultimedia.co.uk
Server broadcast messages or any message sent on an intrusive basis to any directly or indirectly attached network Attempt to circumvent any user authentication or security of host, network, or account. Accessing data not intended for user. Probing the security of any network. Spawning dozens of processes. Port scans, ping floods, packet spoofing, forging router information, Denial of Service attacks, sniffers, flooding, spoofing, ping bombing, smurfs, winnuke, land, teardrop. Circulation of viruses. IRC bots such as eggdrop or BitchX. Any activity, whether or not the intrusion results in the corruption or loss of data, will be investigated and proper action taken.
The presence of any of these programs, whether or not run, will result in action against the user including suspension or termination.
CLIENT RESPONSIBILITY:
The client is responsible for all activity originating from the web hosting account, unless proven to be a victim of outside hacking or address forgery.
When a Client maintains their own website, this requires a certain level of knowledge in the use of Internet languages, protocols, and software. This level of knowledge varies depending on the anticipated use and desired content of the web space by the client.
The following examples are offered:
Web Publishing: requires knowledge of HTML, properly locating and linking documents, FTP-ing Web contents, Graphics, text, sound, image mapping, etc. FrontPage web publishing: knowledge of the FrontPage tools as well as Telnet and FTP understanding and capability.
CGI-Scripts: requires a knowledge of the UNIX environment, TAR & GUNZIP commands, Perl, CShell scripts, permissions, etc.
MAIL: a use of mail clients to receive and send mail, etc.
The Client agrees that he or she has the necessary knowledge to create and maintain their web space.
The Client agrees that it is not Mosaic’s responsibility to provide this knowledge or support, outside matters specific to Mosaic’s hosting services.
TELNET/SSH
We do not allow telnet or SSH/shell access to our servers. This is non-negotiable and for the security of all clients on the servers. The SSL (port 22) and Telnet (port 23) ports are fire walled out on our network gateway.
BANDWIDTH and SERVER RESOURCES
If your bandwidth reaches the point where it has an adverse affect on other clients we reserve the right to disable your site/sites until you can reduce your bandwidth usage.
Any site consistently using more than 20% of system resources will be immediately suspended. Sites of this nature should reside on a dedicated server.
LIMITATION OF LIABILITY:
Mosaic shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Mosaic’s servers going off-line or being unavailable for any reason whatsoever.
Further, Mosaic shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Mosaic’s servers. All damages shall be limited to the immediate termination of service.
Mosaic shall be the sole arbiter of what is and is not a violation of these acceptable use policies.
Mosaic reserves the right to terminate a hosting account at any time and for any reason that causes harm to any Mosaic customer's web sites.
Mosaic reserves the right to delete all content and files upon termination.
Mosaic reserves the right to withhold any pre-paid funds for any site removed for violations of these policies.
Mosaic reserves the right to refuse, cancel, or suspend service at our sole discretion.
CANCELLATIONS
If a hosting package is cancelled, where a domain name has been included in the hosting package, we will charge you for this domain at our normal rates and you will be refunded the hosting fee minus the domain registration cost.
DESIGN FOR PRINT & LOGO SERVICES:
Mosaic provides Logo Design services and Design for Print to clients across a wide spectrum of industry and entertainment.
We agree the Design Package with the Client and will deliver within a specified deadline suitable to the Client’s needs.
The Design Package determines the number of concepts presented.
The chosen Design for Print / Logo concept is finalised and delivered in file formats suitable for both Print and Internet / On-screen purposes, as appropriate – on CD-ROM and in hard copy.
PRINTING:
Mosaic provides ALL necessary print files to the Client on CD-ROM/DVD/Floppy Disk (we can also upload digital files direct to a Print company on the Client’s behalf - if that option exists).
Mosaic does NOT provide quantity print output. We can provide examples of Print companies to the Client and help you organise the quantity print output from our finished files - but we are not connected to these Print companies in any way, so therefore CANNOT be held responsible for any problems caused by third party Print companies.
OFF-LINE MULTIMEDIA PRESENTATIONS:

A quotation will be provided in writing, and if agreed by the Client, an estimated start date for the project will be confirmed by Mosaic. Upon receipt of all files / elements (logo, literature, documents, photos etc.) a prototype design/layout will be presented to the Client.
Upon agreement to proceed, a ‘Sign Off’ date for the project will be presented to the Client for approval. This ‘sign off’ date is the date by which Mosaic estimates the multimedia project will be ready for publication to CD-ROM / DVD / Floppy Disk.
PLEASE NOTE: A deposit will be required in advance (usually equal to 30% of the total price of the full multimedia development costs quoted).
CREDIT / PAYMENTS:
We are unable to offer any form of credit.
If your account/service is activated before any payment is made then payment must be sent in full by return. (e.g. Web Hosting and Domain Name Registration)
If your account is cancelled and is later reactivated, an administration fee may be levied – that fee will be presented prior to any action, for the client’s confirmation to proceed.
DEPOSIT PAYMENTS:
A Deposit (usually equal to 30% of the total price of the full web / design project development costs quoted) is normally required in advance - for larger commissions such as E-Commerce and Database Driven Website projects and Offline Multimedia Presentations – this is to cover software purchase costs (where applicable) and all research and some of the development time, on our client’s behalf, plus all further consultation and proof design work.
FINAL PAYMENT should be made within 14 days of the client’s ‘sign off’ date.
If an account reaches 14 days overdue we will suspend all your sites.
If an account reaches 30 days overdue we will remove all sites and data from our systems.
During this period we will attempt to contact you by all methods possible.
GENERAL:
Mosaic shall not be responsible for any loss of Clients' turnover, sales, revenue, profits or indirect, consequential or special loss.
